Effective Date: August 4, 2026 · Last Updated: October 11, 2026
VJG Apex Global Inc. d/b/a Apex Capital Partners (“Apex Capital Partners,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit apexcappartners.com, submit a funding application, upload documentation, or communicate with us by email, telephone, or text message.
By using our website or services, you agree to the terms of this Privacy Policy. If you do not agree, please do not use our website or submit information to us.
1. Information We Collect
Information You Provide Directly
- Contact information: name, business name, mailing address, email address, and mobile and business telephone numbers.
- Business and financial information: information submitted through our funding application at apexcappartners.com/apply, including business type, time in business, revenue, funding amount requested, and ownership details.
- Supporting documentation: materials you upload at apexcappartners.com/upload, which may include bank statements, tax returns, financial statements, government-issued identification, and other stipulations required to process your application.
- Communications: the content of emails, text messages, and call records exchanged with us.
Information Collected Automatically
- IP address, browser type, device identifiers, operating system, referring URLs, pages viewed, and timestamps.
- Cookies and similar technologies used to operate the site, remember preferences, and measure performance.
Information From Third Parties
- Credit bureaus, business data providers, banking verification services, and public records, where permitted by law and in connection with evaluating a funding application.
2. How We Use Your Information
- To receive, evaluate, underwrite, and respond to funding applications.
- To request, collect, and review stipulations and supporting documentation.
- To communicate with you about your application status, scheduling, and servicing of any funding provided.
- To verify identity and prevent fraud.
- To comply with legal, regulatory, and recordkeeping obligations.
- To operate, maintain, secure, and improve our website and services.
3. SMS and Text Message Communications
Apex Capital Partners does not sell or share mobile information, SMS opt-in data, or SMS consent with third parties or affiliates for promotional or marketing purposes.
If you provide your mobile telephone number and affirmatively consent to receive text messages, Apex Capital Partners may send you SMS messages regarding your application status, requested documentation, appointment scheduling, and related servicing matters.
Marketing text messages. Separately, if you check the optional marketing text box on our application form or our re-engagement form, or, as an existing customer, reply YES to an email from us that states this marketing-text consent, Apex Capital Partners may also send you promotional text messages about financing offers, new or renewal funding programs, and occasional greetings, up to 4 messages per month. This is a separate consent from application texts: you may give either one, both, or neither, and neither is required to apply for or receive funding. Replying STOP to any message ends both.
- Consent. Consent to receive text messages is obtained on our application form at apexcappartners.com/apply through a separate, optional checkbox that is unchecked by default. Checking it is not required to submit an application, and consent is not a condition of applying for or receiving funding. Existing customers may also opt in to marketing texts by replying YES to an email from us that states the full consent, including offers and funding updates by text at up to 4 messages per month; the reply is recorded with the exact wording, the time and the number. You may withdraw consent at any time by replying STOP.
- Message frequency. Message frequency varies depending on the status and activity of your application.
- Message and data rates. Message and data rates may apply. You are responsible for any charges imposed by your mobile carrier.
- Opting out. You may withdraw consent at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. You will receive a confirmation and no further messages will be sent, except as required to complete an active transaction or as otherwise permitted by law.
- Help. Reply HELP for assistance, visit apexcappartners.com, or email info@apexcappartners.com.
- Carrier liability. Mobile carriers are not liable for delayed or undelivered messages.
We may share information with service providers that assist us in delivering our messaging services, including telecommunications carriers and messaging platform providers, solely as necessary to provide those services.
SMS opt-in data and consent will not be shared with third parties for purposes unrelated to providing the SMS program for which you provided consent.
4. How We Share Information
We do not sell your personal information. We may share information in the following circumstances:
- Service providers. Vendors who perform services on our behalf, such as hosting, document storage, identity verification, payment processing, and customer communications, under contractual confidentiality obligations.
- A funding partner, only when it benefits you. We fund files with capital from our own investor partners. If your file qualifies for better terms than they can offer, we may share the application and documents needed to underwrite it with one outside funder matched to your file. Text messaging originator opt-in data and consent are never included.
- Funding partners and underwriters. Where necessary to evaluate, place, or service a funding request you have submitted.
- Legal and regulatory. Where required by law, subpoena, court order, or governmental request, or to protect our rights, property, or safety, or that of others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
Text messaging originator opt-in data and consent are excluded from all of the above categories. They are never shared with any third party for marketing or promotional purposes, and are shared with messaging service providers only as needed to deliver the SMS program described in Section 3.
5. Cookies and Tracking
We use cookies and similar technologies to operate our site, remember your preferences, and analyze traffic. You may configure your browser to refuse cookies, though some features of the site may not function properly as a result.
6. Data Security
We maintain administrative, technical, and physical safeguards designed to protect your information, including encryption in transit for documents submitted through apexcappartners.com/upload. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Data Retention
We retain your information for as long as necessary to fulfill the purposes described in this Policy, to comply with legal and regulatory recordkeeping requirements, to resolve disputes, and to enforce our agreements.
8. Your Rights and Choices
- Access and correction. You may request access to, or correction of, the personal information we maintain about you.
- Deletion. You may request deletion of your personal information, subject to legal and regulatory retention obligations.
- Marketing communications. You may opt out of marketing emails using the unsubscribe link in any message, and out of text messages by replying STOP.
- State privacy rights. Residents of California, Virginia, Colorado, Connecticut, Utah, and other states with applicable privacy laws may have additional rights, including the right to know, delete, correct, and opt out of certain processing, and the right to be free from discrimination for exercising those rights.
