1. Acceptance

By using this website or submitting an application, you agree to these Terms of Use. If you do not agree, do not use the site.

2. Eligibility

You represent that you are at least 18 years of age, an authorized signer for the business you represent, and a US resident or US-domiciled entity.

3. Application Authorization

By submitting an application, you authorize Apex Capital Partners and its underwriting agents to (a) verify the accuracy of submitted information, (b) perform a soft credit inquiry, and (c) contact you regarding your application by phone or email. A hard credit inquiry will not be performed without your separate written consent.

4. No Guarantee of Financing

Submission of an application does not guarantee approval, funding amount, or any specific terms. All financing is subject to underwriting review.

5. Text Messaging Program

If you check the optional text messaging box on our application, Apex Capital Partners will send you text messages about your funding application, including application confirmations, document requests, and call scheduling. Consent is optional and is not a condition of applying. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time; reply HELP for help. Marketing texts. If you check the separate, optional marketing text box on our application or re-engagement form, or reply YES to an email from us that states this consent, Apex Capital Partners will also send you promotional text messages about financing offers, new or renewal funding programs, and occasional greetings. 6. Intellectual Property

All content on this site is owned by Apex Capital Partners or licensed for our use. You may not reproduce, distribute, or modify content without our written permission.

7. Disclaimers; Limitation of Liability

The site is provided “as is.” To the maximum extent permitted by law, Apex disclaims all warranties and shall not be liable for indirect, incidental, or consequential damages.

8. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Delaware.
